Competition Terms and Conditions

To enter the Where’s Bot been? Campaign share a photo or video via Instagram or Twitter with the hashtag #wheresbotbeen (all of these activities are called ‘Submissions’ in these Terms and Conditions)

The timeframe to participate is between 10th August 2019 00.01 BST to 27th August 2019 23.59 BST.

Participation in the campaign is free of charge and no purchase is necessary.

By sharing a Submission, you are agreeing to be bound by these terms and conditions.

1. GENERAL RULES

If you share a Submission with the hashtag #wheresbotbeen we may ask permission to use the Submission for commercial purposes, including in offline ad campaigns.

You may be asked if you agree to this commercial use in one or more of the following ways:

– On Twitter, via an @ message

– On Instagram, via a comment posted to your submission

By responding to this request with a message that features the text #iagree, you are indicating acknowledgment that you have read and understand the licence conditions in part 9 and 10 below.

Participants violating these terms and conditions will be excluded from the #wheresbotbeen campaign, will not be eligible to receive any prizes or incentives associated with the campaign, and may be subject to further action.

Note that any Submission that contains criminal or anti-social behaviour, hate, sexually suggestive, discriminatory, unlawful, infringing, violent, nudity, foul language or any other content which The Automobile Association deems unacceptable or which does not fit the needs of The Automobile Association shall not be considered in the campaign.

2. ELIGIBILITY

The campaign is open to individuals aged 18 and over excluding employees of The Automobile Association (or The Automobile Association’s holding or subsidiary companies, or The Automobile Association’s agents or suppliers professionally connected with the campaign) and their families or households. Proof of age and residence may be required. The Automobile Association reserves the right to exclude any participant and/or any prize recipient if he/she does not comply with any of these terms and conditions. You warrant that the submission was created by you the participant, does not violate, misappropriate or infringe on the rights of any third party, including, without limitation, privacy rights, publicity rights, copyrights, trademark and/or other intellectual property rights and that you have the legal right and capacity to enter into these Terms and Conditions in your jurisdiction. Note that entry is open to individuals only; corporate entities are not eligible to participate in this campaign. Submissions that are automatically generated by computer will not be eligible. All entries must be created using the Automobile Association’s AA Bot Drop app.

3. PARTICIPATING COUNTRIES

The campaign is open only to individuals with permanent residence in the following countries:

4. HOW TO PARTICIPATE IN THE CAMPAIGN

To enter into the campaign the entrant must share a Submission with the hashtag #wheresbotbeen that meets the campaign requirements set out in these terms and conditions between the start and finish dates specified at the beginning of these terms and conditions.

Tips:

– If using Instagram, you must ensure your Instagram account is not set to “private” to participate in the campaign.

– If using Twitter, you need to have “private tweets” in your Twitter account disabled to participate in the campaign.

The total number of total people that can participate is not limited. Entries on behalf of another person will not be accepted and joint submissions are not allowed.

You will need a device with a functioning internet connection and a compatible AR kit/AR core device to participate in the campaign.

5. MANNER OF SELECTION

Winners of the 4 x £250 voucher prizes (See section 6 of these Terms and Conditions) will be selected at random using our ‘Random Pick’ tool uses a cryptographic-level random number generator (RNG) to select a random submission from all approved and confirmed submissions gathered since the campaign start.

These winners will be selected on the following dates of the campaign:

13th August

17th August

22nd August

The Winner will of the £1000 grand prize will be selected by The Automobile Association – this is a game of skill. The Automobile Association’s jury will select based on equal amount of objective criteria of originality and creativity, and will select the best submission posted by the participants The Automobile Association’s jury will consist of two representatives from The Automobile Association, and one external representative from TMP Worldwide.

Winners will be notified by private message to the account the submission was entered. Notification of winning will come from the AA careers social media channel. If a winner fails to confirm acceptance by replying to the notification of winning the prize within 3 working days, The Automobile Association reserves the right to offer the prize to the next eligible entrant selected by the jury that were received before the finish date.

The prize may not be claimed by a third party on your behalf.

6. PRIZE DESCRIPTION

During the campaign The Automobile Association will award winners from the contributions that will receive one of the following products:

1) £250 Red Letter day voucher

2) £1000 Exodus Holiday voucher

Value of prize to be awarded is between £250 and £1000 GBP. Prizes are subject to availability. The Automobile Association reserves the right to exchange prizes with a similar or higher valued product due to unavailability.

If the prize involves travel, you will be responsible for ensuring that you and any person travelling with you are available to travel and hold valid passports, any necessary visas and travel documents for the holiday in question on the travel dates specified.

The prize will supplied directly by TMP Worldwide of 265 Tottenham Court Road, London W1T 7RQ on behalf of The Automobile Association.

7. PRIZE ACCEPTANCE

In case of receipt of a prize or incentive, you agree not to sell, transfer, offer to sell, return or use the prize for any commercial or promotional purpose. The Automobile Association reserves the right to substitute the prize of equal or greater value in the event that circumstances beyond its control ensue. Eligible prizes will be selected by The Automobile Association.

A list of winners can be received by writing one week after the completion of the campaign to Lorna Gillam, TMP Worldwide, 265 Tottenham Court Road, London W1T 7RQ including your name, address and a stamped addressed envelope.

Insofar as is permitted by law, The Automobile Association, its agents or distributors will not in any circumstances be responsible or liable to compensate the winner or accept any liability for any loss, damage, personal injury or death occurring as a result of taking up the prize except where it is caused by the negligence of The Automobile Association, its agents or distributors or that of their employees. Your statutory rights are not affected.

8. LIABILITY

Insofar as is permitted by law, The Automobile Association, its agents or distributors will not in any circumstances be responsible or liable to compensate the winner or accept any liability for any loss, damage, personal injury or death occurring as a result of taking up the prize except where it is caused by the negligence of The Automobile Association, its agents or distributors or that of their employees. Your statutory rights are not affected.

9. LICENCE CONDITIONS

By agreeing to commercial use of the Submission via ‘#iagree’ message you agree that your Submission, username, name and likeness may be published as per the ‘COPYRIGHT AND MORAL RIGHTS’ section below, for example on:

– The Automobile Association website

– The Automobile Association social media channels

– Print advertisements for The Automobile Association and their products and services

– Online display advertisements for The Automobile Association and their products and services

– Online search advertisements for The Automobile Association and their products and services

– Offline (e.g. print and television) advertisements for The Automobile Association and their products and services

– Outdoor advertisements for The Automobile Association and their products and services

Your data may be used and published within the scope of the campaign; see Section “Publicity and Data Protection” below. The Automobile Association may also contact you via email but your email address will not be made public.

By agreeing to commercial use of the Submission via ‘#iagree’ message, you agree and confirm to that Automobile Association that:

  • Any text, images video or audio-visual content in the Submission are your own original works, are not defamatory and do not infringe third-party rights.
  • There are no conflicting agreements in place that restrict usage of the Submissions.
  • You have consent to use any third-party image in the entry and rights have been waived for that use. If a third party image is of a person under 18, parental or guardian consent must be provided.

You will produce evidence of any required consents at The Automobile Association’s request.

10. COPYRIGHT AND MORAL RIGHTS

USAGE RIGHTS IN SUBMISSIONS. By making a Submission and confirming that Submission via ‘#iagree’ message, you acknowledge and agree that you will retain ownership of any original content you submit, subject to the following licence: The Automobile Association shall have the unrestricted and non-exclusive right to reproduce, distribute, display, edit, adapt, publish, perform, broadcast, modify, and otherwise use each Submission (or any part of it) in any and all media, whether now known or later discovered, in perpetuity, without compensation you or any other party. You also agree to waive your moral rights, including the right to be identified as an author of a work and the right not to have your work subject to derogatory treatment.

INTELLECTUAL PROPERTY INFRINGEMENT NOTICE: we may respond to DMCA take-down notices and remove any Submissions if that Submission is suspected of copyright infringement or any other intellectual property right infringement. To challenge a submission or issue a take-down request please write to Lorna Gillam, TMP Worldwide, 265 Tottenham Court Road, London W1T 7RQ.

11. PUBLICITY AND DATA PROTECTION

If you are the winner of a prize, you agree that The Automobile Association may use your name, image and town or county of residence to announce the winner of this competition and for any other reasonable and related promotional purposes. You further agree to participate in any reasonable publicity required by The Automobile Association.

By participating in the campaign, you agree that any personal information provided by you with the competition entry (including your social network username) may be held and used only by The Automobile Association or its agents and suppliers to administer the competition.

12. NETWORK AND COMMUNICATION

If for any reason the campaign does not run for its duration due to a computer virus, tampering, unauthorized intervention, fraud, technical failures or any other cause beyond the control of The Automobile Association that corrupts or affects the administration, security, fairness, integrity or proper conduct of the campaign, The Automobile Association reserves the right in its sole discretion to cancel, terminate, or suspend the campaign and disqualify any individual who tampers with the entry and/or voting process. The Automobile Association is not responsible for any: (a) malfunction, delay or traffic congestion on any network or line, computer system, servers or providers, computer equipment, software, or website; (b) failure of any email or entry to be received by The Automobile Association; nor (c) any injury or damage to participants or any other person related to or resulting from participation in the campaign or down loading any materials in a campaign. Promoter suggests you maintain you own back up of your submission. The Automobile Association cannot be responsible for loss of Submissions nor content removed by Instagram or Twitter.

13. TERMINATION

The Automobile Association reserves the right within its discretion to terminate your participation, hide your Submission and or any other user generated content, and restrict your use and access to any Automobile Association campaign. Agreement to these Terms and Conditions survive, and the licence for use of your Submission continues, after your social media account has been terminated. A request for termination of this agreement can be made in writing to Lorna Gillam, TMP Worldwide, 265 Tottenham Court Road, London W1T 7RQ.

The Automobile Association reserves the right to hold void, suspend, cancel, or amend the prize competition where it becomes necessary to do so.

14. DISPUTES

The Automobile Association reserves the right, and disclaims any perceived, implied or actual duty, to monitor or manage disputes between participants. You agree to hold The Automobile Association and their suppliers or agents harmless in connection with any dispute or claim you make against any other participant.

15. DECISIONS

The Automobile Association’s decision will be final and binding on all participants, and no correspondence regarding the campaign and decisions will be entered in to.

16. INDEMNITY

Without limiting any indemnification provision of these Terms and Conditions, you agree to defend, indemnify and hold harmless The Automobile Association and its officers, directors, employees, agents, affiliates, representatives, sub-licensees, successors, and assigns (collectively, the ”Indemnified Parties”) from and against any and all claims, actions, demands, causes of action and other proceedings (collectively, “Claims”), including but not limited to legal costs and fees, arising out of or relating to: (i) Your breach of these Terms and Conditions, including without limitation any representation or warranty contained in this them; (ii) Your participation in Where’s Bot been; (iii) Your provision to The Automobile Association or any of the Indemnified Parties of any Submission, information or other data; (iv) Your violation or alleged violation of any applicable law or regulation; or (v) Your violation or alleged violation of any third party’s copyrights, trademarks, or other intellectual property or proprietary rights.

The Indemnified Parties will have the right, but not the obligation, to participate through counsel of their choice in any defence by you/participant of any Claim as to which you are required to defend, indemnify or hold harmless the Indemnified Parties. You may not settle any Claim without the prior written consent of the concerned Indemnified Parties.

17. DISCLAIMER

This is in no way sponsored, endorsed or administered by, or associated with Twitter or Instagram. The information you provide will only be used for the competition. By entering the competition all participants accept that they will have no claim against Twitter or Instagram whatsoever and agree to give them a complete liability release from any and all legal liability in connection with the promotion. This campaign is in no way sponsored, endorsed or administered by, or associated with Instagram or Twitter. You are providing your information to the Promoter, not Instagram, or Twitter.

18. JURISDICTION

These Terms and Conditions are governed by and construed in accordance with English law and any dispute arising from them or Where’s Bot been? shall be subject to the exclusive jurisdiction of the English courts.
